WanaGetAway Club, LLC, a Florida limited liability company ("Club"), offers travel-related programs and benefits (the “Network”) to its Members. For reference purposes only, Member may be referred to as "Member", "You" or "Your". 

 

Member is purchasing a membership in the Club’s Network (the "Membership"). The Membership Level is WanaGetAway 365 Trial. Member makes the following acknowledgments and representations and agrees to the terms and conditions of the Network set forth below and in the Network Materials: 

 

  • Account Login. Your access to the Network Benefits will begin within 15-60 minutes if Your Membership purchase is completed during Club’s business hours and if outside of Club’s business hours, Your access to the Network Benefits will begin at 10am on the following day after you completed Your Membership purchase. Club’s business hours are Monday-Sunday 10am-8pm. Your login instructions will be e-mailed to You once Your access to the Network Benefits begins. Any updates or changes to the Network Benefits, rules of usage of the Network Benefits and any costs associated with the Network Benefits will be set forth in the Network Materials.  

 

  • Membership Term. Your Membership Term is the duration of Your Membership. Your Membership Term is 1 month.  

 

  • Payment of Purchase Price. You agree and authorize the Club to debit/charge the Purchase Price in full from Your selected Payment Method on this Checkout Page.  

 

  • Purchase Price Refunds. If You wish to cancel Your Membership purchase, You may cancel within three days of Your purchase by calling 1-863-259-3016 or by visiting Your account page while logged into Your WanaGetAway Membership. If You cancel, Club will give You a full refund of Your Purchase Price. 

 

  • Satisfaction Guarantee. If You attend a 10-minute webinar to learn how to get the most value out of the Membership, You may cancel for any reason within fourteen days of Your purchase and receive a full refund of Your Purchase Price.  

 

  • Trial Membership. At the end of Your Membership Term You agree and authorize the Club to convert Your Membership to the WanaGetAway 365 Basic Membership and to debit/charge $500.00 from Your selected Payment Method on this Checkout Page. Upon conversion to WanaGetAway 365 Basic, You will have 11 months remaining in Your WanaGetAway 365 Basic Membership Term. If You do not want to convert Your Membership to a WanaGetAway 365 Basic Membership, You may cancel Your Membership any time prior to the expiration of the Membership Term by calling 1-863-259-3016 or by visiting Your my account page while logged into Your WanaGetAway Membership and Club will not convert Your Membership and will not charge Your selected Payment Method on this Checkout Page. 

 

  • Membership. The Membership entitles You to travel benefits and other related services and privileges in connection with the Network (collectively, the “Network Benefits”). You are initially entitled to receive the Network Benefits on a non-exclusive basis for Your Membership Term. Network Benefits are further described in and are subject to these Acknowledgments & Summary of Terms & Conditions, the logged-in areas of the “Network Website” (www.wanagetaway.com), the terms and conditions on the "CLUB365 Website" (www.theclub365.com) and in such other written materials as may be e-mailed to Your e-mail addresses on file and as may be updated by Club from time to time and all of which shall be deemed to be incorporated herein (collectively the “Network Materials”). 

 

  • Network Benefits. The current Network Benefits of Your Membership include the right of You, subject to all Network Materials, to request and receive:  

 

  • CLUB365. Member shall be a member of CLUB365 and entitled to all the benefits and services set forth on the CLUB365 website. 

 

A complete description of current Network Benefits is set forth on the Network Website and the CLUB365 Website. Club reserves the right, in its sole discretion and without advance notice, to add, modify or delete Network Benefits. Club does not make any guaranty or assurance as to the continued availability of any specific Network Benefit. 

 

  • Third party vendors, providers and suppliers. Club may contract with third party vendors, providers and suppliers to provide any of the Network Benefits. All third party vendors, providers and suppliers are separate and distinct from, and not agents/employees of Club and Club does not accept any liability for such third party vendors, providers and suppliers actions or omissions. 

 

  • Savings claims and benefits providers. All savings claims made by Club in respect to Network Benefits are based on price comparisons with retailers for comparable services at the price at which such products are offered and sold. You acknowledge and agree that You have had the opportunity to examine a list of Network Benefits suppliers and a description of the nature thereof. 

 

  • Subject matter of Network. The Network is not a timeshare plan and the Membership is not a timeshare interest or real estate interest. Your purchase of the Membership does not provide You with ownership in or the recurring right to use any specific accommodation or facility. The services to be provided under these Acknowledgments & Summary of Terms & Conditions shall commence as of the purchase date of Your Membership and the primary purpose of this Membership is not the right to purchase or receive goods and services in the future. The Membership is not a legal or beneficial interest in Club, the Network, or any affiliates thereof or their assets and does not entitle You to any share of income, gain or voting interest. The Network Benefits are not obtained or provided from the cooperative purchase of services/merchandise and You are not obtaining ownership or participation in any discount buying organization. 

 

  • Limitation of liability. You acknowledge and agree that Club, nor their affiliates or employees shall be made liable for, and You hereby release such persons from, and waive all claims whatsoever for: (a) any personal or bodily injury, damage, loss or theft of personal property that occurs in connection with Your receipt of any Network Benefits; (b) any incidental, consequential, or special damages of any kind; (c) any damages, losses, penalties, expenses or costs resulting from any act or omission of any other individual or entity providing products and/or services in connection with the Network Benefits; (d) any accident, loss, injury, or damage in connection with any accommodations, transportation, cruise, or other services; (e) and any liability of such persons in connection with any claim or action arising out of or in connection with the Membership and/or Network Benefits shall be limited to reimbursement of amounts which You have paid to Club hereunder. 

 

  • Transfer/assignment. Except as expressly provided herein, Your Membership and receipt of Network Benefits are personable to You and not assignable or transferable, in whole or in part; provided that Club may permit You to sell or otherwise transfer Your Membership if: (i) You are current in all payment obligations; (ii) You pay to Club the applicable transfer fee (currently two hundred fifty ($250.00) dollars, subject to change in Club’s sole discretion); and (iii) Your transferee agrees, in writing, to comply with all the Terms and Conditions of the Network Materials. Club may assign all or any part of its/their right, title and interest hereunder to any person or entity so long as such assignment does not materially and adversely affect Your rights as Member(s) and upon any such assignment such assignor shall be completely released from all duties, claims, demands, or causes of action arising from or relating to the Membership and these Acknowledgments & Summary of Terms & Conditions occurring after the date of such assignment. 

 

  • Additional Members. You acknowledge that you may add five additional members to your Membership. 

 

  • Privacy Policy and Communicating with You. You acknowledge that Club will use Your personal data provided herein for identification, verification and contact, lodging and tourist services fulfillment, and as necessary to provide Membership services to you including with the agents to which we have a legal or business relationship with. You understand that Club will inform You of present or future Membership benefits, products and services and other promotional offers related to Your Membership through email and by mail for consideration. For more information about terms and conditions over use of your personal data, treatment and the procedure to exercise your ARCO rights, you may review Club's full Privacy Policy available on the Network Website. You expressly consent to receiving relevant information and product offers from Club relating to Your Membership on Your cellular telephone number(s) provided above using automated telephone dialing technology which may play recorded messages or via text message. Message & data rates may apply. 

 

  • Breach of Terms & Conditions. Your Membership may be suspended or terminated by Club if you breach any provision of these Acknowledgments & Summary of Terms & Conditions. Termination, whether caused by breach, Your election not to renew Your Membership or otherwise, does not relieve You of any obligations relating to Your Membership, and all monies You previously paid will be retained as liquidated damages, and not as a penalty. Suspended or terminated Members shall not be obligated for any past or future membership dues. 

 

  • Representations. You represent and agree that (a) You are at least twenty-one (21) years of age and have the capacity to acquire the Membership; (b) Your acquisition of the Membership is solely for personal enjoyment, is based upon its value for accessing vacation/leisure services, and is not for investment purposes of acquiring or with an expectation that Your Membership may be resold for a profit; (c) no aspect of the Membership or the Network has been represented to You as an investment opportunity and no representations have been made to You concerning rentals, rental pools, returns, tax advantages, depreciation or investment potential; (d) the Purchase Price is solely for the Membership and does not include any benefits or services outside of those defined within the Membership or Network; (e) representatives of Club or their affiliates may offer products and services to You via telephone, mail or email solicitations; (f) Club may, from time to time, change Terms & Conditions of continued enjoyment of the Membership and receipt of Network Benefits, and such changes shall be deemed to be automatically incorporated into and made a part of these Acknowledgments & Summary of Terms & Conditions; and (g) these Acknowledgments & Summary of Terms & Conditions and any other documents expressly referred to herein are the only instruments relating to Your Membership and You may not rely upon any other representations, oral or written. 

 

  • Applicable Law/Venue/Jurisdiction/Severability. You acknowledge and agree that this purchase shall be construed, interpreted and enforced in accordance with the laws of the State of Florida, and that the courts of Orange Country, Florida, shall be the exclusive venue and jurisdiction for all disputes arising out of this purchase, to which venue and exclusive personal jurisdiction You hereby consent and subject Yourself. Should any part of this purchase be deemed invalid under applicable law, the remaining parts of these Acknowledgments & Summary of Terms & Conditions shall be in full force and effect as though any unenforceable part or parts were not written into these Acknowledgments & Summary of Terms & Conditions.

  • Renewal Membership Fee. The initial duration of Your Membership is paid through Your initial Membership Term, with an option (subject to the terms hereof) to renew for subsequent twelve (12) month Membership Terms thereafter. You agree to pay the Renewal Membership Fee amount to Club, currently established at $250. Such Renewal Membership Fee is subject to change at Club’s sole discretion, provided, however, any increase in the Renewal Membership Fee shall not exceed an amount equivalent to a five (5%) percent annualized increase. Approximately sixty (60) days prior to the expiration of Your Membership Term, You will receive a notice to Your e-mail address provided on this Checkout Page alerting You to the pending expiration of (and the option to continue) Your Membership. If Club does not receive transaction of the then applicable Renewal Membership Fee prior to the expiration of Your Membership Term, then, in the sole discretion of Club, Your Membership shall be suspended and Club may require transaction of a re-instatement fee (currently $99.00, but subject to change in Clubs sole discretion), in order to lift the suspension and renew the Membership. During the suspension period, You will not have access to any of the Network Benefits and you may be at risk of losing balances accrued for Network Benefits. 

 

  • Automatic Billing/Payment for Renewal Membership Fee. You authorize Club or its assigns to collect the Renewal Membership Fee through Automatic Billing/Payment using Your selected Payment Method on this Checkout Page, within thirty (30) days of the expiration of Your Membership Term. Member shall complete such additional forms and/or processes as necessary and required by Club or its assigns to continue or establish the Automatic Billing/Payment. You understand by electing to have Your Renewal Membership Fee paid by Automatic Billing/Payment, You have been afforded a forty ($40.00) dollar discount. Cancellation of Automatic Billing/Payment will result in an increase of Your Renewal Membership Fee amount by forty ($40.00) dollars. 

 

  • Payment of moneys for travel and Renewal Membership Fee. All fees as may be due, including, but not limited to, Renewal Membership Fee and travel fees should be directed and made payable to: WanaGetAway Club, 3816 Industry Blvd., Lakeland, Florida 33811, Phone: 1-844-WGA-CLUB (1-844-942-2582), or such other location as Club may require.

Network Benefits are further described in and are subject to these Acknowledgments & Summary of Terms & Conditions, the logged-in areas of the “Network Website” (www.wanagetaway.com), the terms and conditions on the "CLUB365 Website" (www.theclub365.com) and in such other written materials as may be e-mailed to Your e-mail addresses on file and as may be updated by Club from time to time and all of which shall be deemed to be incorporated herein (collectively the “Network Materials”). 

 

  • Renewal Membership Fee. The initial duration of Your Membership is paid through Your initial Membership Term, with an option (subject to the terms hereof) to renew for subsequent twelve (12) month Membership Terms thereafter. You agree to pay the Renewal Membership Fee amount to Club, currently established at $200. Such Renewal Membership Fee is subject to change at Club’s sole discretion, provided, however, any increase in the Renewal Membership Fee shall not exceed an amount equivalent to a five (5%) percent annualized increase. Approximately sixty (60) days prior to the expiration of Your Membership Term, You will receive a notice to Your e-mail address provided on this Checkout Page alerting You to the pending expiration of (and the option to continue) Your Membership. If Club does not receive transaction of the then applicable Renewal Membership Fee prior to the expiration of Your Membership Term, then, in the sole discretion of Club, Your Membership shall be suspended and Club may require transaction of a re-instatement fee (currently $99.00, but subject to change in Clubs sole discretion), in order to lift the suspension and renew the Membership. During the suspension period, You will not have access to any of the Network Benefits and you may be at risk of losing balances accrued for Network Benefits. 

 

  • Automatic Billing/Payment for Renewal Membership Fee. You authorize Club or its assigns to collect the Renewal Membership Fee through Automatic Billing/Payment using Your selected Payment Method on this Checkout Page, within thirty (30) days of the expiration of Your Membership Term. Member shall complete such additional forms and/or processes as necessary and required by Club or its assigns to continue or establish the Automatic Billing/Payment. You understand by electing to have Your Renewal Membership Fee paid by Automatic Billing/Payment, You have been afforded a forty ($40.00) dollar discount. Cancellation of Automatic Billing/Payment will result in an increase of Your Renewal Membership Fee amount by forty ($40.00) dollars. 

 

  • Payment of moneys for travel and Renewal Membership Fee. All fees as may be due, including, but not limited to, Renewal Membership Fee and travel fees should be directed and made payable to: WanaGetAway Club, 3816 Industry Blvd., Lakeland, Florida 33811, Phone: 1-844-WGA-CLUB (1-844-942-2582), or such other location as Club may require. 

 

  • Third party vendors, providers and suppliers. Club may contract with third party vendors, providers and suppliers to provide any of the Network Benefits. All third party vendors, providers and suppliers are separate and distinct from, and not agents/employees of Club and Club does not accept any liability for such third party vendors, providers and suppliers actions or omissions. 

 

  • Savings claims and benefits providers. All savings claims made by Club in respect to Network Benefits are based on price comparisons with retailers for comparable services at the price at which such products are offered and sold. You acknowledge and agree that You have had the opportunity to examine a list of Network Benefits suppliers and a description of the nature thereof. 

 

  • Subject matter of Network. The Network is not a timeshare plan and the Membership is not a timeshare interest or real estate interest. Your purchase of the Membership does not provide You with ownership in or the recurring right to use any specific accommodation or facility. The services to be provided under these Acknowledgments & Summary of Terms & Conditions shall commence as of the purchase date of Your Membership and the primary purpose of this Membership is not the right to purchase or receive goods and services in the future. The Membership is not a legal or beneficial interest in Club, the Network, or any affiliates thereof or their assets and does not entitle You to any share of income, gain or voting interest. The Network Benefits are not obtained or provided from the cooperative purchase of services/merchandise and You are not obtaining ownership or participation in any discount buying organization. 

 

  • Limitation of liability. You acknowledge and agree that Club, nor their affiliates or employees shall be made liable for, and You hereby release such persons from, and waive all claims whatsoever for: (a) any personal or bodily injury, damage, loss or theft of personal property that occurs in connection with Your receipt of any Network Benefits; (b) any incidental, consequential, or special damages of any kind; (c) any damages, losses, penalties, expenses or costs resulting from any act or omission of any other individual or entity providing products and/or services in connection with the Network Benefits; (d) any accident, loss, injury, or damage in connection with any accommodations, transportation, cruise, or other services; (e) and any liability of such persons in connection with any claim or action arising out of or in connection with the Membership and/or Network Benefits shall be limited to reimbursement of amounts which You have paid to Club hereunder. 

 

  • Transfer/assignment. Except as expressly provided herein, Your Membership and receipt of Network Benefits are personable to You and not assignable or transferable, in whole or in part; provided that Club may permit You to sell or otherwise transfer Your Membership if: (i) You are current in all payment obligations; (ii) You pay to Club the applicable transfer fee (currently two hundred fifty ($250.00) dollars, subject to change in Club’s sole discretion); and (iii) Your transferee agrees, in writing, to comply with all the Terms and Conditions of the Network Materials. Club may assign all or any part of its/their right, title and interest hereunder to any person or entity so long as such assignment does not materially and adversely affect Your rights as Member(s) and upon any such assignment such assignor shall be completely released from all duties, claims, demands, or causes of action arising from or relating to the Membership and these Acknowledgments & Summary of Terms & Conditions occurring after the date of such assignment. 

 

  • Additional Members. You acknowledge that you may add five additional members to your Membership. 

 

  • Privacy Policy and Communicating with You. You acknowledge that Club will use Your personal data provided herein for identification, verification and contact, lodging and tourist services fulfillment, and as necessary to provide Membership services to you including with the agents to which we have a legal or business relationship with. You understand that Club will inform You of present or future Membership benefits, products and services and other promotional offers related to Your Membership through email and by mail for consideration. For more information about terms and conditions over use of your personal data, treatment and the procedure to exercise your ARCO rights, you may review Club's full Privacy Policy available on the Network Website. You expressly consent to receiving relevant information and product offers from Club relating to Your Membership on Your cellular telephone number(s) provided above using automated telephone dialing technology which may play recorded messages or via text message. Message & data rates may apply. 

 

  • Breach of Terms & Conditions. Your Membership may be suspended or terminated by Club if you breach any provision of these Acknowledgments & Summary of Terms & Conditions. Termination, whether caused by breach, Your election not to renew Your Membership or otherwise, does not relieve You of any obligations relating to Your Membership, and all monies You previously paid will be retained as liquidated damages, and not as a penalty. Suspended or terminated Members shall not be obligated for any past or future membership dues. 

 

  • Representations. You represent and agree that (a) You are at least twenty-one (21) years of age and have the capacity to acquire the Membership; (b) Your acquisition of the Membership is solely for personal enjoyment, is based upon its value for accessing vacation/leisure services, and is not for investment purposes of acquiring or with an expectation that Your Membership may be resold for a profit; (c) no aspect of the Membership or the Network has been represented to You as an investment opportunity and no representations have been made to You concerning rentals, rental pools, returns, tax advantages, depreciation or investment potential; (d) the Purchase Price is solely for the Membership and does not include any benefits or services outside of those defined within the Membership or Network; (e) representatives of Club or their affiliates may offer products and services to You via telephone, mail or email solicitations; (f) Club may, from time to time, change Terms & Conditions of continued enjoyment of the Membership and receipt of Network Benefits, and such changes shall be deemed to be automatically incorporated into and made a part of these Acknowledgments & Summary of Terms & Conditions; and (g) these Acknowledgments & Summary of Terms & Conditions and any other documents expressly referred to herein are the only instruments relating to Your Membership and You may not rely upon any other representations, oral or written. 

 

  • Applicable Law/Venue/Jurisdiction/Severability. You acknowledge and agree that this purchase shall be construed, interpreted and enforced in accordance with the laws of the State of Florida, and that the courts of Orange Country, Florida, shall be the exclusive venue and jurisdiction for all disputes arising out of this purchase, to which venue and exclusive personal jurisdiction You hereby consent and subject Yourself. WanaGetAway Club, LLC, a Florida limited liability company ("Club"), offers travel-related programs and benefits (the “Network”) to its Members. For reference purposes only, Member may be referred to as "Member", "You" or "Your". 

 

Member is purchasing a membership in the Club’s Network (the "Membership"). The Membership Level is WanaGetAway 365 Premium. Member makes the following acknowledgments and representations and agrees to the terms and conditions of the Network set forth below and in the Network Materials: 

 

  • Account Login. Your access to the Network Benefits will begin within 15-60 minutes if Your Membership purchase is completed during Club’s business hours and if outside of Club’s business hours, Your access to the Network Benefits will begin at 10am on the following day after you completed Your Membership purchase. Club’s business hours are Monday-Sunday 10am-8pm. Your login instructions will be e-mailed to You once Your access to the Network Benefits begins. Any updates or changes to the Network Benefits, rules of usage of the Network Benefits and any costs associated with the Network Benefits will be set forth in the Network Materials.  

 

  • Membership Term. Your Membership Term is the duration of Your Membership. Your Membership Term is 12 months.  

 

  • First Day Incentives. You acknowledge that Club shall cover the cost of and has given You the following incentives on a one-time basis for purchasing today: Your Initial Membership Fee of $200 for Your Initial Membership Term and two (2) 7-Night Resort Vacation Certificates. The 7-Night Resort Vacation Certificates will be e-mailed to You 15 days after Your Membership purchase is completed.  

 

  • Payment of Purchase Price. You agree and authorize the Club to debit/charge the Purchase Price in full from Your selected Payment Method on this Checkout Page.  

 

  • Purchase Price Refunds. If You wish to cancel Your Membership purchase, You may cancel within three days of Your purchase by calling 1-863-259-3016 or by visiting Your account page while logged into Your WanaGetAway Membership. If You cancel, Club will give You a full refund of Your Purchase Price. 

 

  • Satisfaction Guarantee. If You attend a 10-minute webinar to learn how to get the most value out of the Membership, You may cancel for any reason within fourteen days of Your purchase and receive a full refund of Your Purchase Price.  

 

  • Network Benefits. The current Network Benefits of Your Membership include the right of You, subject to all Network Materials, to request and receive:  

 

  • CLUB365. Member shall be a member of CLUB365 and entitled to all the benefits and services set forth on the CLUB365 website. 
  • 7-Night Resort Vacation Certificates. Purchase 7-Night Resort Vacation Certificates for $200 each. 

 

A complete description of current Network Benefits is set forth on the Network Website and the CLUB365 Website. Club reserves the right, in its sole discretion and without advance notice, to add, modify or delete Network Benefits. Club does not make any guaranty or assurance as to the continued availability of any specific Network Benefit. 

 

  • Membership. The Membership entitles You to travel benefits and other related services and privileges in connection with the Network (collectively, the “Network Benefits”). You are initially entitled to receive the Network Benefits on a non-exclusive basis for Your Membership Term, and You have the option to renew your Membership, so long as the Network Benefits are offered, for subsequent 12 month Membership Terms as herein provided.
